DATA RENTENTION AND DELETION
We retain PII we collect from you where we have an ongoing legitimate business need to do so (for example, to comply with applicable legal, tax or accounting requirements, to enforce our agreements or comply with our legal obligations). To determine the appropriate retention period for PII, we consider the amount, nature, and sensitivity of the PII; the potential risk of harm from unauthorized use or disclosure of your PII; the purposes for which we process your PII and whether we can achieve those purposes through other means; and the applicable legal requirements.
When we have no ongoing legitimate business need to process your PII, we will either permanently delete or anonymize it or, if this is not possible (for example, because your PII has been stored in backup archives), then we will securely store your PII and isolate it from any further processing until deletion is possible. When processing Customer Content on behalf of our customers, we will retain Customer Content as described in our agreement with that customer.
YOUR LEGAL RIGHTS
Under the General Data Protection Regulation 2016/679 (the GDPR) and the California Consumer Protection Act (CCPA), data subjects located in the EU, UK, and California have the right under certain circumstances:
- To be provided with a copy of your PII held by us.
- To request that we correct any of your PII held by us.
- To request that we restrict the processing of your PII (while we verify or investigate your concerns with this information).
- To object to any further processing of your PII, including the right to object to marketing.
- To request that the PII you have provided be transferred to a third party.
- To withdraw consent, without detriment, where the basis of the processing of your PII is based on consent.
- To request that we delete any of your PII held by us unless a legal exception applies.
To exercise your rights, please submit your verifiable request at [email protected]. California residents may also exercise their privacy rights by calling us at +1 (877) 360-3442.
You will not have to pay a fee to access your PII (or exercise any other rights). We may, however, charge a fee if we believe your request is excessive, unfounded, or repetitive. Alternatively, we may refuse to comply with your request in these circumstances.
Verifying your Identity when you make Requests under CPRA
If you are an office-based employee/contractor, we can verify your identity by meeting in person to confirm you made the request. If you are not an office-based employee/contractor:
- Request to know categories of PII: Data Science Dojo will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you with data points maintained by Data Science Dojo that we determine to be reliable for the purpose of verifying your identity.
- Request to know specific pieces of PII: Data Science Dojo will verify your identity to a reasonably high degree of certainty by matching at least three pieces of PII provided by you with data points maintained by Data Science Dojo that we determine to be reliable for the purpose of verifying your identity, together with, should we deem it necessary, a declaration signed by you under penalty of perjury that it is your PII that is the subject of the request. Data Science Dojo shall maintain all signed declarations as part of its record-keeping obligations.
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
If your request or concern is not satisfactorily resolved by us, and you are located in the EU or UK, you may approach your local data protection authority (see https://ec.europa.eu/info/law/law-topic/data-protection_en.html) who can provide further information about your rights and our obligations in relation to your PII, as well as deal with any complaints that you have about our processing of your PII.
YOUR PRIVACY RIGHTS IN RESPECT TO CUSTOMER CONTENT
If PII pertaining to you as an individual has been submitted to the Service by or on behalf of a Data Science Dojo customer and you wish to exercise any data protection rights you may have in respect of that information under applicable law, including (as applicable) the right to access, port, correct, amend or delete such information, please inquire with the relevant Data Science Dojo customer directly. We have a limited ability to access Customer Content.
