Terms of Service

This is a legal and binding agreement between you, the user (referred to as “user” or “you”) and Data Science Dojo LLC, including its entities and affiliates (referred as “we”, “us” or “Data Science Dojo”). This agreement outlines Terms of Service governing your use of any products and services provided by Data Science Dojo (the “Service”).

Please read these Data Science Dojo Terms of Service, Privacy Policy, and other policies on the website before accessing any product or using any of our course materials or services. By registering on our website or by visiting, browsing, or using Data Science Dojo services in any manner, you acknowledge that you have the legal right, authority, and capacity to bind yourself to this agreement, and you agree to be bound by the terms and conditions of this agreement.

If you are registering on our website or visiting, browsing, or using Data Science Dojo services on behalf of any entity, you represent and warrant that you have the legal right, authority, and capacity to accept these terms on behalf of such entity, and that such entity agrees to indemnify you and Data Science Dojo for any violations of these terms. If you do not agree to all the terms and conditions of this agreement, you must notify Data Science Dojo immediately and you are not authorized to use any portion of the Company’s website, products, or services.

Our acceptance is expressly conditioned upon your assent to all the terms and conditions of this agreement, to the exclusion of all other terms. If these terms and conditions are considered an offer by us, acceptance is expressly limited to these terms.

YOUR RIGHT TO USE

Where we provide content to you in connection with the course, including, without limitation, the Data Science and Data Engineering Handbooks, Jupyter Notebooks, Slide Decks, Practical Exercises (including notebooks or sandboxes), and Recorded Sessions, it is collectively referred to as “material” or “course material.” The services provided by Data Science Dojo are licensed, not sold. Subject to these terms and our policies, we grant you a limited, personal, non-exclusive, non-transferable, non-assignable, and freely revocable license to access and use our course material. You may download and print the material an unlimited number of times solely for your personal, non-commercial use, provided you maintain all copyright and other notices contained in such material. The risk of loss for course material transfers to you upon downloading or accessing the course material.

The material is protected by United States and foreign copyright laws. You are solely responsible for all services, telephony, data charges, and/or other fees and costs associated with your access to and use of the material and our services, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use. You also agree that you will not share with any third party access to the course, the material, your login information, readings, references, links, or other information, nor will you facilitate third-party access to the material or the information contained in the material.

All of your use, access and other activities relating to course and the materials must be in compliance with all applicable laws and regulations, including, without limitations, laws relating to copyright and other intellectual property use, and to privacy and personal identity. In connection with your use and access, you must not provide incorrect or knowingly false information; you may not copy, sell, resell, reproduce, publish, distribute, modify, transfer, retransmit, reverse engineer, commercially exploit, deface, tarnish, mutilate, hack, or interfere with other’s access to the materials or use of our services.

If you signed up for the Sensei package (including mentoring), you agree that you have read and understood the ‘Mentoring Terms and Conditions‘.

PROHIBITED USE

You shall not access or use, nor encourage, promote, facilitate, or instruct others to access or use, the website or the Service for any illegal, harmful, or offensive purposes, or to transmit, store, display, distribute, or otherwise make available content or data that is illegal, harmful, or offensive. Prohibited activities or content include but not limited to the following: 

1- Illegal or Infringing Activities: Users are prohibited from accessing or using the website or the Service in violation of any applicable law, rule, or regulation, or in violation of any third party’s rights. This includes, but is not limited to:

The use or transmission of any data or material protected by copyright, trademark, trade secret, patent, or other intellectual property rights without proper authorization.
The use or transmission of any material that constitutes an illegal threat or violates export control laws.

2- Offensive Content: Users are prohibited from transmitting content that is obscene, offensive, defamatory, or otherwise objectionable.

3- Harmful Content: Users are prohibited from transmitting any data, sending, or uploading any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code.

4- Unauthorized Use and Interference: Users are prohibited from accessing or using the website or the Service to violate the security or integrity of any network, computer, or communications system, software application, or network or computing device (each, a “System”). Users may not:

Engage in any activities that may interfere with the ability of others to access or use the website or the Service; or
Attempt to gain unauthorized access to the accounts or passwords of other Users; or
Monitor any data, information, or communications on any System without authorization.

5- Other Prohibited Uses: Users are prohibited from:

Reselling or redistributing the Service, or any part thereof, or otherwise using the Service for any purpose other than their own personal or internal business use, unless pursuant to a separately executed agreement between the user and Data Science Dojo;
Reverse engineering, distributing, modifying, transmitting, reusing, reposting, using, or creating derivative works based on the content of the website or the Service, in whole or in part, for any purpose, without written permission from Data Science Dojo;
Using the website or the Service for any mission or life-critical purposes, including the migration of any data which, if lost or corrupted, could endanger the health or safety of any person;
Using the website or the Service in ways that may be harmful to others or to Data Science Dojo’s reputation, including the use of any portion of the Service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages;
Using the website or the Service in any manner that Data Science Dojo otherwise states on the website or the Service is prohibited.

RESERVATION OF RIGHTS

All rights with respect to the course material, whether now existing or which may come into existence in the future, which you are not expressly granted in these Terms of Service, are reserved to Data Science Dojo. Without limitation, and except as provided elsewhere in these Terms of Service, we specifically reserve all rights, whether now existing or which may come into existence in the future, to: make any derivative works of the material; to copy or reproduce the material; to combine the material, in whole or in part, with any other materials; transmit or download the material or derivative works through electronic, digital, telephonic, optical, or other means; to alter or modify in any way the material or any derivative works; or, to publically perform or display the material.  The “Data Science Dojo” name, logo, and seal is the trademark of Data Science Dojo C-Corporation. You may not use this Trademark, or any variation thereof, without our prior written consent. You may not use this Trademark, or any variation thereof, for promotional purposes, or in any way that deliberately or inadvertently claims, suggests or, in our sole judgment, gives the appearance or impression of a relationship with or endorsement by us. Should you use this Trademark with or without our prior written consent, you agree that any goodwill developed by your use of the mark shall accrue to Data Science Dojo. You agree to not adopt a mark in the future that is or may be confusingly similar to this Trademark. You may not register a domain name that is confusingly similar to this Trademark. In addition, the look and feel of the website, including all page headers, custom graphics, button icons and scripts, is the service mark, trademark and/or trade dress of Data Science Dojo and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and names or logos mentioned on the website are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by us.  Data Science Dojo does not take responsibility for the content or other sites, that you may find when searching or accessing our products or services. The Privacy Policy and Terms of Use of the sites that you visit will administer that material.  Data Science Dojo has all the rights to disable or prohibit access to the users who do not respect and involve in the infringement of Data Science Dojo intellectual property.  Nothing in this Agreement or in the materials should be construed as granting, by implication, estoppel or otherwise, any license or right to use the Trademark without the written permission of the owner of the Trademark. 

TERM AND TERMINATION

The term of your right to access the course material (the “Term”) shall commence upon the effective date of this agreement and continue for a period of up to three months, unless this agreement is terminated earlier than this date.  Your rights under this Agreement will automatically terminate if you fail to comply with any term of this Agreement. In case of such termination, you must cease all use of the course material, and Data Science Dojo may immediately revoke your access to the course material and our services without refund of any fees. Our failure to insist upon or enforce your strict compliance with these Terms of Service will not constitute a waiver of any of our rights.  You agree that we, in our sole discretion, may terminate your use of and access to the material or your use of our services, for any reason or no reason, upon notice to you. We reserve the right at any time, in our sole discretion, to cancel, delay, reschedule or alter the format of the course, or to cease providing any or part or all services, and you agree that we will not have any liability to you for such an action.  If you no longer desire to take the course or use the material, you may terminate your participation at any time. The rights granted to you hereunder to use and access our services and materials will end upon any termination, but other provisions of these Terms of Service will survive such termination.  All material shall be returned to the Company within seven days following termination. You may not retain any copies, notes, or source code; you must return all Company proprietary information which you were granted access to. 

THIRD-PARTY SERVICE

Data Science Dojo may link to third-party websites to facilitate its provisions of service to you. If you use these links, you will leave Data Science Dojo service. Data Science Dojo is not responsible for these third-party websites, whether or not Data Science Dojo is affiliated with such third-party websites. You agree that Data Science Dojo is not responsible or liable for any loss or damage of any sort incurred as a result of your use of third-party websites or as a result of the presence of any third-party advertising on Data Science Dojo services. 

REPORTING COPYRIGHT VIOLATIONS

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials posted on the Daja Science Dojo infringe your copyright, you (or your agent) may send Data Science Dojo a “Notification of Claimed Infringement” requesting that the material be removed, or access to it blocked. The notice must include the following information: 

A physical or electronic signature of a person authorized to act on behalf of the owner of the works that have been allegedly infringed; 
Identification of the copyrighted work alleged to have been infringed (or if multiple copyrighted works located on the Daja Science Dojo Services are covered by a single notification, a representative list of such works); 
Identification of the specific material alleged to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Data Science Dojo to locate the material on the Data Science Dojo Services; 
Your name, address, telephone number, and email address (if available); 
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and 
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send Data Science Dojo a counter-notice. 
 
Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA; see here  for details. Notices and counter-notices with respect to the Data Science Dojo Services should be sent to 2205 152nd Ave NE Redmond, WA 98052. ([email protected]). Consult your legal advisor and see 17 U.S.C. § 512 before filing a notice or counter-notice as there are penalties for false claims under the DMCA. 

MISCELLANEOUS

These Terms of Service constitute the entire agreement between you and Data Science Dojo. There is no agency, partnership or joint venture relationship between any user and Data Science Dojo arising solely through the use of this website. These Terms of Service are binding upon your successors, assigns, heirs and executors. If any provision of these Terms of Service is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Term of Service, which shall remain in full force and effect. The failure of Data Science Dojo to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or condition. Any claim or cause of action arising out of or related to the website, or these Terms of Service must be filed within one year after such claim or cause of action arose. The section titles of these Terms of Service are merely for convenience and will not have any effect on the substantive meaning of this agreement.

PRIVACY POLICY & CONSENT

Data Science Dojo’s Privacy Policy is located here. We will process and store profile information that you will provide to us in accordance with this policy. We may also send you service announcements, administrative messages and other information in connection with your use of the service. You may opt out of particular communications. 

DISCLAIMER OF WARRANTY

The material and any information, content, or services made available to you are provided “as is” and “as available” without warranty of any kind (express, implied, or otherwise), including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except insofar as any such implied warranties may not be disclaimed under applicable law.  Data Science Dojo does not warrant that the material or courses provided will meet your needs or expectations. Data Science Dojo also makes no warranty about the accuracy, completeness, timeliness, or quality of the material or any course or content, or that any particular material or content will continue to be made available.  Use of the material and our services is at your own discretion and risk, and you will be solely responsible for any damage to your property (including your computer system) or loss of data that results from the download or use of such material or data. Data Science Dojo takes all reasonable effort to maintain the cleanliness and purity of our data and materials, but we make no warranty that any particular material or content is free of virus or malware. 

LIMITATION OF LIABILITY

To the maximum extent permitted by law, you agree that neither Data Science Dojo, or any of its employees or representatives, or any of your fellow course participants, will be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these Terms of Service, or your (or any third party’s) use of or inability to access the material or course, or your reliance upon information obtained from Data Science Dojo or its employees or representatives, whether your claim is based in contract, tort, statutory, or other law.  In particular, to the fullest extent permitted by law, neither Data Science Dojo, or any of its employees or representatives, or any of your fellow course participants will have any liability for any consequential, indirect, punitive, exemplary, or incidental damages, whether foreseeable or unforeseeable and whether or not Data Science Dojo or any of the course participants has been negligent or otherwise at fault (including, but not limited to, claims for defamation, errors, loss of profits, loss of data or interruption of available data.)  You acknowledge and agree that the disclaimers and the limitations of liability set forth in these Terms of Service reflect a reasonable and fair allocation of risk between you and Data Science Dojo, and that these limitations are an essential basis to our ability to make services available to you on an economically feasible basis.  You agree that any cause of action brought by you against Data Science Dojo, or its affiliates related to the material, or your use of our services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred from adjudication by a court of law, arbitration, or mediation proceeding. If a court of competent jurisdiction finds that this clause is not enforceable, you agree that any cause of action related to the material, or your use of our services shall be governed by Washington state statute of limitations.  Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights. 

INJUNCTIVE RELIEF

You agree that any breach of your obligations with respect to Data Science Dojo’s proprietary or intellectual rights will result in irreparable injury to Data Science Dojo for which money damages are inadequate, you therefore agree that Data Science Dojo shall be entitled to seek injunctive relief, without the requirement of posting a bond, in addition to any other relief that a court may deem proper.

CHANGES

Data Science Dojo reserves the right to change or modify these Terms of Service, or any policy or guideline of the website, at any time and in our sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the website, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the website following the posting of changes or modifications will confirm your acceptance of such changes or modifications. Therefore, you should frequently review these Terms of Service and applicable policies to understand the terms and conditions that apply to your use of the website. INTERNATIONAL USERS

Data Science Dojo Services are operated from the United States but may be accessed in other parts of the world. If you are located outside of the United States and you access or use Data Science Dojo services, you acknowledge, understand and agree that you are doing so at your own initiative and at your own risk and that it is your responsibility (and not Data Science Dojo) to make sure that your use of Data Science Dojo services complies with all applicable local laws in the jurisdiction from where you access or use Data Science Dojo services. If you are located in the United Kingdom, for purposes of the Data Protection Act 1998, Data Science Dojo is the data controller with respect to any information collected by it in the United Kingdom and then transferred to Data Science Dojo in the United States. By submitting any personally identifiable information to us through Data Science Dojo services, you consent to the transfer, processing and storage of your information in the United States in accordance with our Privacy Policy. 

APPLICABLE LAW/ FORUM SELECTION

You agree that these Terms of Service and any claim or dispute arising out of or relating to these Terms of Service, or any content or services obtained from or through this agreement be governed by the laws of the State of Washington, excluding its conflicts of law provisions, when applicable, and the laws of the United States of America when applicable. You agree that all such claims and disputes will be heard and resolved exclusively in the federal or state courts located in and serving Seattle, Washington. You consent to the personal jurisdiction of and exclusive venue in the federal courts located in and serving Seattle, Washington as the legal forum for any such dispute. And you waive and agree not to assert any objection to such proceedings in those courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum). 

INDEMNIFICATION

You agree to defend, hold harmless, and indemnify Data Science Dojo and Data Science Dojo course participants, and their respective subsidiaries, affiliates, officers, faculty, students, fellows, owners governing board members, agents, and employees with respect to any claim, demand, cause of action, debt or liability, including reasonable attorneys’ fees, to the extent that it is based upon a claim that, if true, would constitute a breach of any of your obligations under these Terms of Service. 

ARBITRATION

Excluding claims for injunctive or other equitable relief, for claims where the total amount sought is less than fifty thousand U.S. Dollars ($50,000.00 USD) the parties shall first attempt to resolve the dispute through binding non-appearance-based arbitration using a mutually agreed upon established alternative dispute resolution (“ADR”) provider. The parties and the selected ADR provider shall not involve any personal appearance by the parties or by witnesses, unless otherwise mutually agreed by the parties; rather, the arbitration shall be conducted, at the option of the party seeking relief, by telephone, or via written submissions alone. Any judgment rendered by the Arbitrator shall be entered in a court of competent jurisdiction  You agree that arbitration for any cause of action brought by you against Data Science Dojo or its affiliates related to the material, or your use of our services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred from adjudication. 

PHOTO AND VIDEO CONSENT

Data Science Dojo reserves the right to use any photograph/video taken at any event hosted by Data Science Dojo, without the expressed written permission of those included within the photograph/video. Data Science Dojo may use the photograph/video in publications or other media material produced, used or contracted by Data Science Dojo including but not limited to brochures, invitations, books, newspapers, magazines, television, websites, social media etc. 

To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian. 

A person attending a Data Science Dojo event who does not wish to have their image recorded for distribution should make their wishes known to the photographer, and/or the event organizers, and/or contact Data Science Dojo representatives at [email protected], in writing of his/her intentions and include a photograph. Data Science Dojo will use the photo for identification purposes and will hold it in confidence. 

By participating in a Data Science Dojo event or by failing to notify Data Science Dojo, in writing, your desire to not have your photograph used by Data Science Dojo, you are agreeing to release, defend, hold harmless and indemnify Data Science Dojo from any and all claims involving the use of your picture or likeness. 

Any person or organization not affiliated with Data Science Dojo may not use, copy, alter or modify Data Science Dojo photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from Data Science Dojo. 

HONOR CODE

HONOR CODE PLEDGE 

By enrolling in a course, I agree that I will: 

Complete all tests and assignments on my own, unless collaboration on an assignment is explicitly permitted. 
Maintain only one user account and not let anyone else use my username and/or password. 
Not engage in any activity that would dishonestly improve my results, or improve or hurt the results of others. 
Not post answers to problems that are being used to assess student performance.

VIOLATIONS 

If you are found in violation of the Terms of Service or Honor Code, you may be subject to one or more of the following actions: 

Receiving a zero or no credit for an assignment; 
Having any certificate earned in the course withheld or revoked; 
Being unenrolled from a course; or 
Termination of your use of the Site. 
Additional actions may be taken at the sole discretion of Data Science Dojo and its Member course providers.

No refunds will be issued in the case of any corrective action for such violations. 

Honor code violations will be determined at the sole discretion of Data Science Dojo Members. You will be notified if a determination has been made that you have violated this honor code and you will be informed of the corresponding action to be taken as a result of the violation. 

CHANGING THE HONOR CODE 

Please note that we review and may make changes to this Honor Code from time to time. Any changes to this Honor Code will be effective immediately upon posting on this page, with an updated effective date. By accessing the Site after any changes have been made, you signify your agreement on a prospective basis to the modified Honor Code and any changes contained therein. Be sure to return to this page periodically to ensure familiarity with the most current version of this Honor Code.
